ESTA also manages the provision of advanced, operational communications for Victorias emergency services. These operational communications support police, fire, ambulance and VICSES personnel in the field by carrying radio calls over the Metropolitan Mobile Radio Service (MMR), data transactions on the Mobile Data Network (MDN) and delivering messages to CFA, VICSES and Ambulance Victoria volunteers and staff via the state-wide Emergency Alerting System (EAS).

About the Role
The Legal Counsel FOI and Privacy supports the General Counsel and Board Secretary and the wider ESTA legal team to contribute to strategic decision making and legal risk management across the organisation.
In this role you will work with internal stakeholders at all levels within the organisation and provide expert legal advice on a broad range of complex legal issues, particularly in the areas of privacy, data protection and requests for information; inter-governmental relationships and data sharing agreements; and disputes/breaches.
This role operates within a complex stakeholder environment in the emergency management sector. The Legal Counsel FOI and Privacy will identify innovative solutions to balance stakeholder requirements and ensure ESTAs compliance with legislative, public sector regulatory and policy frameworks.
Key Accountabilities
1. Provide timely, expert and authoritative legal advice on a range of complex and challenging issues, to executives, senior management and other internal stakeholders in respect of statutory interpretation (including interpretation of the ESTA Act and privacy and related legislation).
2. Conduct and facilitate privacy impact assessments and lead the implementation of a Privacy by Design approach at ESTA.
3. Protect the interests of the organisation by proactively identifying privacy and data protection risks, strategies and potential solutions to address those risks whilst also contributing to a positive culture of risk management.
4. Provide advice and assistance with assessment and reporting in relation to incidents, risks and compliance obligations for privacy and data protection.
5. Maintain an understanding of the current and emerging legal and regulatory environment for privacy, health records and data protection and provide advice and training on changes to the laws.
6. Monitor and review privacy and health records practices and processes within the organisation, identify and lead continuous improvement initiatives, and build staff capability through the development of guidance materials.
7. Working with ESTAs FOI and Information Access Officers, ensure all information access requests are effectively and efficiently analysed, considered and responded to in a timely and thorough manner, with sensitivity and in a manner that recognises ESTAs legal obligations.
8. Working with ESTAs FOI and Information Access Officers, develop systems, processes and practical tools including training to support FOI and information access requests.
9. Provide timely advice and assistance to the General Counsel & Board Secretary regarding the operation of the information access function. Recognise issues and risks to be addressed in responding to the information access requests and ensure these issues are appropriately addressed as part of ESTAs response.
10. Manage the outsourcing of external legal services, as required.
11. Promote the vision and goals of the organisation both internally and externally, with professionalism and enthusiasm and in accordance with ESTA, Emergency Management Sector and Victorian Public Sector plans and policies.
12. Foster and maintain a positive protective security culture at ESTA by adhering to security policies, standards, and procedures, reporting suspected and actual security incidents and ensuring sensitive and classified public sector information is protected from unauthorised disclosure or compromise
13. Maintain a safe, positive and productive work environment free from discrimination, bullying and harassment; comply with ESTA policies and procedures.
14. At the request of ESTAs General Counsel and Board Secretary, carry out the duties of ESTAs Privacy Officer in accordance with ESTAs Privacy Policy.
15. Other duties as directed by the General Counsel and Board Secretary, consistent with the above duties and responsibilities.
