Reporting to the Director within the Chief Counsel Legal Division, this leadership role is accountable for undertaking work with a high level of complexity to deliver quality outcomes across the Administrative Appeals Tribunal (AAT) functions of the NDIA.
In this role, you will manage, progress and resolve AAT applications, often assessing complex information against legislative criteria and policy to determine the most suitable method to conduct AAT proceedings. Your key focus will be to resolve matters in a timely manner and, where reasonably possible, without a need to progress to an AAT hearing.
You will actively manage and foster key internal and external stakeholder relationships and represent and negotiate on behalf of the NDIA in order to advance the NDIAs interests across a range of forums.
Key Responsibilities include:
- Undertaking end to end case management activities, subject to appropriate line manager input.
- Resolving matters through case management of AAT applications in relation to reviewable decisions in section 100 of the NDIS Act 2013, including NDIS plan and access decisions.
- Undertaking case management of highly complex AAT matters and analysing to develop recommendations for early resolution.
- Applying alternate dispute resolution methods and advocacy skills to resolving applications/reviews, in keeping with the model litigant principles.
- Attending Case Conferences, Conciliations, Hearings conducted by the AAT.
- Preparing documents detailing resolution options and outcomes at Case Management meetings.
- Assessing and responding to priority and risks, including risk to the participant, Scheme sustainability and the NDIA.
- Contributing to the preparation of reports, business cases, meeting submissions and correspondence.
- Preparing and maintaining electronic record keeping, including evidence supporting decision making processes and justifying conclusions reached during the case management process.
- Leading and contributing to strategic projects and policy development processes.
- Leading development of and contribution to Ministerial and Parliamentary briefs.
- Leading a team and/or a scope of work, including mentoring, supervising, training and supporting junior Case Managers.
Ideally you will possess:
- A legal and/or similar background and previous experience with the AAT will be highly regarded
- Outstanding interpersonal and communication skills with superior stakeholder management experience ensuring optimum results
- Effective leadership and decision making skills to identify and understand problems and opportunities and proven dispute resolution skills/experience.
- Supporting and coaching individuals in the team to develop trust, maximise knowledge, skills to ensure a commitment to successful outcomes.
